Why Honesty is Critical in Your Slip and Fall Lawsuit

A man from New Jersey is now facing charges of fraud after he was caught on a surveillance video faking a slip and fall accident at what is now his former place of employment. In the video, Alexander Goldinsky is seen dumping ice on the floor of the breakroom at his workplace. After that, he threw his cup in the trash, walked over to the ice and “fell” on the floor. He stayed laying on the floor flat on his back until he was discovered.

He was charged with theft by deception and insurance fraud because prosecutors say the fall was not an accident. Although Goldinsky claims the charges are a mistake, investigators with the case say the footage is clear. After the breakroom incident, Goldinsky filed claims for ambulance and emergency room treatment for injuries he claims to have suffered.

Why Honesty is Imperative

Suffering from a legitimate slip and fall accident can be extremely traumatic, but filing a claim for the accident can make things even more stressful, especially if you are trying to get compensation for your lost wages, medical bills, and pain and suffering. That is where an experienced personal injury attorney comes in to play.

Because of the work involved in a slip and fall accident, some victims may attempt to exaggerate their injuries in an attempt to get more of a settlement. While this may seem like a good plan to get your claim expedited by the insurance company, this could not be any more wrong. Being dishonest with the insurance company can result in a variety of delays, less settlement money, and even a complete denial of your claim. Be certain that the medical records are consistent with the injuries that you sustained.

Insurance Companies and Video Surveillance

Insurance companies are always searching for ways to keep from paying out money for a claim. This means that an insurance agent is not likely to simply take your word when it comes to your injuries. To keep from paying a large settlement, insurance companies will search for ways to discredit your claim. This may include hiring an investigator or using video surveillance to keep an eye on your activities.

While this may not seem fair, it is actually entirely legal for this to happen as long as you are in a public place. In order to take pictures of you through the windows of your home or tap your phone, however, the investigator is required to have a court order. In addition to this surveillance, insurance companies may also monitor your activity on social media to look for information that is inconsistent with your claimed injuries.
